One of the requirements for a business/management visa is that there must be two or more full-time employees residing in Japan in addition to foreign nationals engaged in management or management.

However, it states that those residing with a residence status in the upper column of Appended Table 1 of the Act shall be excluded,'' so foreigners residing with a residence status other than the residence status such asEngineer/Specialist in Humanities/International Services'' may cannot be included in the number of full-time employees.

Those who can be counted as "full-time employees" are Japanese nationals, permanent residents, spouses of Japanese nationals, long-term residents, and foreign nationals with the residence status of permanent residents.

In order to be considered a "full-time employee," the position must be permanent in order to carry out the job, and the salary, etc. must be set in accordance with the job.

In addition, the work must be one in which the employee must be engaged for a specified period of time every day under a certain work schedule.

Please note that part-time work is not allowed, and those working on a temporary basis are not considered "full-time employees."

経営・管理ビザの要件として、経営又は管理に従事する外国人以外に日本に居住する常勤の職員が2人以上勤務する事実があるこというものがあります。

しかし、「法別表第一の上欄の在留資格をもって在留する者を除く」とありますので、「技術・人文知識・国際業務」等、居住資格以外の在留資格で在留する外国人は、この「常勤の職員」の数には含めることはできません。

「常勤の職員」に数えることができるのは、日本人又は永住者・日本人の配偶者等・定住者・永住者の在留資格を有する外国人です。

「常勤の職員」といえるためには、職務を遂行する上で恒常的に置く必要のある職であることが必要で、職務に応じた給与等が設定されていなければいけません。

また、勤務が一定の勤務計画の下に毎日所定の時間中、その時間に従事しなければならないものである必要があります。

パートタイムでの勤務は不可ですし、派遣の形態で勤務している者についても「常勤の職員」とはみなされませんので、注意が必要です。
