2025年の改正により、経営管理ビザの審査では「事業を行うために必要な許認可の取得状況」が明確に確認対象となりました。 これは、単に事業計画や資本金だけでなく、実際にその事業が法的に運営可能な状態にあるかが審査の焦点となることを意味します。
「申請者が営む事業に係る必要な許認可の取得状況等を証する資料の提出を求めます。
（注）在留許可を受けてからでないと許認可の取得ができないなど、正当な理由がある場合には、次回更新時に提出を求めます。」
1. 対象となる「許認可事業」の例
事業内容によっては、営業開始前に行政の許可・登録・届出が必要です。主な例を挙げると次のとおりです。
- 飲食業 → 飲食店営業許可（保健所）
- 中古車販売業 → 古物商許可（警察署）
- 不動産仲介・管理 → 宅地建物取引業免許（都道府県）
- 人材派遣・職業紹介 → 労働者派遣事業許可・職業紹介事業届出（厚生労働省）
- 輸出入・貿易 → 税関登録・経産省届出など
これらの許可を要する業種でありながら、無許可のまま事業開始を計画している場合は不許可となるリスクがあります。
2. 許認可取得前の申請は可能か？
例外的に、「在留許可を得てからでないと許可が取れない」事業については、初回申請時には免除されます。 たとえば、代表者が外国人であるために古物商許可や飲食店営業許可が「在留カードの提示後でなければ受け付けられない」ケースがこれに該当します。
・ 理由書に「在留許可取得後に申請予定」と明記
・ 申請準備資料（図面・申請書案・見積書など）を添付
・ 次回の在留期間更新申請時に許可証の写しを提出
このように、入管は「現時点での法的整備状況」と「将来的な実現可能性」の両面を評価します。
3. 許認可の有無が審査に与える影響
許認可が未取得の場合でも、事業の実現性が高く、申請準備が進んでいることを明確に示せば許可される可能性があります。 一方で、許認可の要否を理解していない、または放置している場合には、事業計画の信頼性を欠くとして不許可につながることがあります。

Under the 2025 revision, Japan’s Immigration Bureau now reviews whether the applicant has obtained all necessary business licenses and permits for the planned business activity. This ensures that the business can legally operate once the visa is granted.
1. Examples of Businesses Requiring Licenses
- Restaurants → Food Service Permit (Public Health Center)
- Used car sales → Secondhand Dealer License (Police)
- Real estate → Real Estate Broker License (Prefecture)
- Staffing/Recruitment → Labor Ministry Permit or Notification
- Import/Export → Customs or METI registration
Operating without the required license can lead to visa denial or later renewal issues.
2. If the License Can Only Be Obtained After Visa Approval
In some industries, a foreign national cannot apply for the license until they have received a residence card. In such cases, applicants can explain the reason and submit proof of preparation (e.g., draft forms or floor plans).
