2025年10月16日施行の省令改正により、経営管理ビザ（Business Manager）を申請する際には、 経営活動の規模に応じた適切な事業所を確保することが明文化されました。 これに伴い、自宅を事務所として兼ねることは原則として認められなくなりました。
出入国管理及び難民認定法施行規則 別表第三 「法別表第一の二の表の経営・管理の項」第１号イ

・ 事業規模に見合う事業所を確保する必要あり
・ 自宅兼事務所は原則不可（特段の事情がある場合を除く）
・ 事業所の契約形態・使用実態も審査対象となる
1. 改正の背景：「見せかけのオフィス」対策
これまで一部の申請では、実態が伴わない自宅兼事務所や、登記のみのバーチャルオフィスが利用されるケースが見られました。
改正後は、こうした形式的な拠点ではなく、実際に経営活動を行うための実体ある事務所の確保が必須とされています。
入管当局は、事業所の規模・立地・用途が事業計画に見合っているかを確認します。
2. 自宅兼事務所が原則認められない理由
新基準では、経営活動の独立性・信頼性を担保する観点から、 自宅兼事務所（自宅の一部をオフィスとして使用する形）は、原則として不適切とされています。
- 事業と生活の区分が曖昧で経営実態を確認しづらい
- 従業員・顧客の出入りや商談スペースの確保が困難
- 契約書・郵便物・登記上の信頼性に欠ける
ただし、業種や事情によっては例外的に認められる余地もあり、 たとえば「自宅敷地内に独立した建物があり、専用オフィスとして機能している場合」などは、 個別判断で許可される可能性があります。
3. 認められるオフィス形態の例
- レンタルオフィス・シェアオフィス（商談・郵便受取・看板設置が可能なタイプ）
- 専用賃貸オフィス（1室専有・契約者が会社名義）
- 事務所一体型店舗（飲食・物販・サービス業などの営業施設内）
契約書・領収書・写真・平面図などを添付して、実際に業務を行っていることを明示することが重要です。
4. 契約時の注意点
- 契約名義は法人または申請者本人（代表者）名義であること
- 契約書に「事務所利用可」「商用可」と明記されていること
- 住宅専用物件・民泊・シェアハウスは不可
- 光熱費・通信設備など事業運営に必要な環境が整っていること

改正後は、事業所の選定が審査通過の出発点となります。 自宅兼オフィスではなく、初期費用を抑えながらも事業実態を示せるレンタルオフィス・サテライトオフィスを選択するのが現実的です。
特に外国人起業者の場合、住所・設備・利用形態を客観的に証明できる資料を整えることが求められます。

As of October 16, 2025, applicants for the Business Manager Visa must secure an office appropriate to the scale of their business. Under the new regulation, using one’s residence as an office is, in principle, no longer permitted.

1. Purpose of the Amendment
This change aims to prevent “paper companies” and applications using non-functional addresses. The Immigration Bureau now requires actual, operational offices that match the business’s stated activities.
2. Why Home Offices Are No Longer Accepted
Home-based offices are considered inappropriate because:
- It is difficult to distinguish business from personal use
- Lack of space for employees, clients, or meetings
- Reduced credibility for contracts, mail, and registration
Exceptions may be made only when there is a separate, independent office structure within the same property that clearly functions as a workplace.
3. Acceptable Office Types
- Rental or shared offices with reception and mailing functions
- Dedicated leased offices contracted under the company’s name
- Shop-type offices (restaurants, retail, or service spaces)
4. Key Points When Contracting an Office
- Lease should be under the company or representative’s name
- “Commercial use permitted” must be stated in the contract
- Residential-only properties or Airbnb-type facilities are not allowed
- Basic utilities and communication facilities must be available
5. Professional Advice
Office selection is now a critical factor for visa approval. Reasonably priced rental or co-working offices are acceptable as long as they provide tangible business functionality and a verifiable address.
